Terms and conditions of sale and use

This English text is a courtesy translation. Only the French version of these terms is legally binding: in the event of any discrepancy or difference of interpretation, the French text prevails.

These Terms and Conditions of Sale and Use (hereinafter the “Terms”) govern the relationship between Pieceautooccasion.eu, operated by Tony B, registered under SIREN 810 953 562, whose registered office is at Allée des Colchiques, 72300 Sablé-sur-Sarthe, hereinafter referred to as “the Platform”, and any natural or legal person using the Platform, hereinafter referred to as “the User”.

The Platform connects Sellers (private individuals or professionals wishing to sell used car parts) with Buyers. Pieceautooccasion.eu is not the seller of the parts offered: it acts as a technical intermediary and as an online platform operator within the meaning of the French Consumer Code.

1. Purpose

These Terms set out the rights and obligations of the parties in connection with the use of the Platform and with the listing and purchase of used car parts through pieceautooccasion.eu.

2. Acceptance of the terms

Registering on the Platform and placing any order imply unreserved acceptance of these Terms. The User declares that they have read and accepted these Terms before creating an account or confirming an order.

3. Registration and user account

Registration is free and open to anyone of legal age. The User undertakes to provide accurate and complete information and to keep it up to date. Creating a Seller account may require identity verification (KYC) through our payment provider Stripe Connect.

4. Listings and products

The parts offered for sale are described by the Sellers under their sole responsibility. The Platform does not guarantee the conformity, the authenticity or the actual condition of the parts presented. Photographs are supplied by the Seller and are indicative only.

Listings for parts that are stolen or counterfeit, that do not meet the type-approval requirements applicable to them, or that present a safety risk (for example: safety-critical braking parts that have not been inspected) are strictly prohibited.

5. Prices and commission

Prices are set freely by the Sellers, in euros (€), inclusive of all taxes where the Seller is subject to VAT, excluding delivery costs.

The Platform charges a commission on every successful transaction, the rate of which is stated in the Seller area and at the time a listing is published. This commission is deducted automatically from the payout made to the Seller through Stripe Connect.

6. Orders and payment

The Buyer confirms their order when they press the “Pay” button at the end of the process. A confirmation email is sent to the Buyer and to the Seller.

Payments are processed by Stripe Payments Europe Ltd, an authorised payment service provider. The Platform stores no banking data. Funds are held in a Stripe segregated account and then paid out to the Seller once dispatch has been confirmed, less the Platform's commission.

7. Delivery

Delivery is the responsibility of the Seller. The arrangements (carrier, timescales, costs) are stated in each listing. The Platform is not a party to the contract of carriage. Risk passes to the Buyer on receipt of the parcel.

In the event of a delay, the Buyer may contact the Seller directly through the Platform's messaging service. If no reply is received within 7 days, the Buyer may refer the matter to the internal mediation service (article 14).

8. Right of withdrawal

In accordance with article L.221-18 of the French Consumer Code, where the Seller is a professional and the Buyer a consumer, the Buyer has 14 days from receipt in which to exercise their right of withdrawal, without having to give a reason.

Between private individuals, the statutory right of withdrawal does not apply. Sales between private individuals are governed by articles 1641 et seq. of the French Civil Code (warranty against hidden defects). The Platform nevertheless encourages private Sellers to offer a goodwill return period.

9. Warranties

Professional Seller: the parts are covered by the statutory warranty of conformity (articles L.217-3 et seq. of the French Consumer Code) and by the warranty against hidden defects (articles 1641 et seq. of the French Civil Code).

Private Seller: only the warranty against hidden defects applies. The Buyer has 2 years from the discovery of the defect in which to bring a claim.

The Platform cannot be held liable for damage resulting from the incorrect fitting or use of the parts purchased, nor for any mismatch between the part and the vehicle it is intended for, which it is for the Buyer to check before purchase.

11. Personal data (GDPR)

The Platform processes Users' personal data in accordance with Regulation (EU) 2016/679 (GDPR) and with the French Data Protection Act. The data collected is necessary for managing accounts, transactions and customer relations.

12. Cookies

The Platform uses only technical cookies necessary for it to work (CSRF, session). No tracking or advertising cookie is set without explicit consent.

13. Intellectual property

All the elements of the Platform (editorial texts, visual identity, logos, source code) are the exclusive property of Pieceautooccasion.eu. The listings and photographs published by Sellers remain the property of their authors, who grant the Platform a non-exclusive, royalty-free licence to use them for as long as the listing is published.

14. Mediation and dispute resolution

In the event of a dispute between Buyer and Seller, the Platform offers an internal mediation service. Users are invited to contact customer services at coucou[@]pieceautooccasion.eu before taking any legal action.

In accordance with articles L.612-1 et seq. of the French Consumer Code, a consumer may refer the matter free of charge to a consumer ombudsman:

The consumer may also use the European online dispute resolution platform.

15. Reporting illegal content (DSA)

In accordance with Regulation (EU) 2022/2065 on digital services (DSA), any User may report illegal content (fraudulent listing, counterfeit goods, and so on) using the dedicated form or by email to coucou[@]pieceautooccasion.eu. Reports are handled within 7 working days.

16. Governing law and jurisdiction

These Terms are governed by French law. In the event of a dispute, and failing an amicable settlement, the competent courts shall be those of the district in which the Platform's registered office is located, unless a legal provision states otherwise (in particular in favour of the consumer).
